Anton van den Heuvel

Specialisation

Anton runs an advice and litigation practice, in which he mainly deals with cases related to tenancy law, commercial property, professional liabilities (i.a. of estate agents) and other liabilities (i.a. asbestos damages). Amongst others, he advises lessors and lessees of business premises, retailers, real estate investors, asset and property managers, franchise organizations, energy transition companies, petroleum companies and cable and water companies. Anton is involved in many real estate projects in Rotterdam and other parts of the Netherlands, for Dutch as well as international clients. He closely cooperates with the notarial department of Ploum and also with external real estate advisors, estate agents, tax lawyers, etc.

Anton has been a lecturer for the 'Circular Construction' course at the Real Estate Business School for several years. In 2023, he started an expert article series on logistiek.nl on the legal route for development of distribution centres.

In 2019 Anton started a partnership with Facilicom Energy Management and AREA Occupier Solutions, in order to create awareness in the market and to advise market parties about the up-coming sustainability requirements regarding offices in the Netherlands (i.a. energy label C in 2023/energy label A in 2030). 

In order to bring projects and legal proceedings to a good end in the real estate world, having just legal knowledge is not enough. It is essential to also have knowledge of the real estate market and the various interests and parties that play a role in it. Anton has been an active member of knowledge and network associations within the real estate market for many years. The knowledge and the network that he gains with this, aid him to successfully run and extend his real estate practice.

I have been working with Anton for many years now. Anton focuses on the needs of the client but also gives proactively alternatives while taking into account the commercial interest of the client within the respective legal boundaries.

Background

Anton studied Dutch law at Erasmus University Rotterdam. During most of his study, he worked several days a week as a professional support lawyer at the department ‘Real estate and administrative law’ of a large Dutch law firm. After his graduation he started at Ploum. In 2012 he passed the exam of the specialisation programme of the Dutch Association of Tenancy law Attorneys cum laude.

Anton heads the Construction and Real Estate department at Ploum since 2015 and in 2018 he became partner.

The people of Ploum’s Construction & Real Estate team are in my experience professional and thorough. Their support in a complex negotiation process regarding a lease agreement and a design & build construction contract for our new head office was well appreciated.

  • Advising on the sale of Inntel Hotels Rotterdam Centre and Mainport by Inntel Hotels in Rotterdam to investor Annexum;
  • Advising Arcus on the (re)issuance of leasehold land due to a substantial expansion of its business premises in Dordrecht and conducting negotiations with the Port of Rotterdam Authority;
  • Advising the Dutch office of French food company Danone on the lease and relocation to office building "The Lobby" in Rijswijk;
  • Advising Joulz on the realisation of an innovative off-grid distribution centre;
  • Advising Rotterdam The Hague Airport about a substantial renovation of its airport;
  • Advising Unilever regarding its real estate in the Netherlands;
  • Advising Orangeworks about the construction and lease of its new head office;
  • Assisting PPF Real Estate with various purchases and sales regarding its real estate portfolio;
  • Advising various retailers (i.a. Geox and Diesel) about their lease agreements in shopping streets and factory/designer outlet centers (such as Batavia Stad and McArthurGlen);
  • Litigating on behalf of a lessee about substantial (climate) defects in a new medical center;
  • Advising Renewi about the development of an innovative bio-LNG installation;
  • Advising Coca-Cola about the lease agreement and project development agreement regarding its new head office in Rotterdam;
  • Litigating on behalf of Kuwait Petroleum regarding its petrol stations;
  • Advising GroenLeven about various real estate related matters, such as solar panels on rooftops projects;
  • Advising a municipality about the transformation of a shopping center into a residential area;
  • Advising various lessors and lessees about the consequences of the corona crisis for their lease agreements

Anton van den Heuvel has registered the following principal (and secondary) legal practice areas in the Netherlands Bar’s register of legal practice areas (rechtsgebiedenregister):

  • Tenancy law (Huurrecht): secondary legal practice areas Business space (Bedrijfsruimte) and Housing (Woonruimte)
  • Real estate law (Vastgoedrecht)
  • Civil procedural law (burgerlijk procesrecht): secondary legal practice areas Attachment and enforcement law (beslag- en executierecht) and Litigation
     

Based on this registration, Anton van den Heuvel is required to obtain ten training credits per calendar year in each registered principal legal practice area in accordance with the standards set by the Netherlands Bar.
