Waste law is a very complicated area of law. This is largely due to the fact that there are many national and international laws and regulations that apply to anyone handling waste materials. A second complicating factor is the definition of "waste": a substance is a waste material as soon as the holder discards or is required to discard it. The question of when this is the case has been considered by many, and there is a substantial amount of case law with regard to this question.
Simultaneously, our society is striving to become increasingly circular. This means that we aim to produce less and less waste, and we are increasingly reusing substances. Nonetheless, our clients still regularly have differences of opinion with the authorities about the question when something is waste, and when it is not. Legal advice from a lawyer is, in such cases, often a 'must'.
