Resolution adopted on generative AI systems

Last October 20, the Global Privacy Assembly, an international assembly of privacy and data protection authorities, adopted a resolution on generative AI systems. This resolution recognises the various concerns in the public debate about the ethical and legal implications of generative AI systems, especially in light of the fundamental right to privacy and the protection of personal data. The resolution therefore stresses, among other things, that generative AI systems should be designed, developed and used in a responsible and trustworthy manner. Developers, providers and users of generative AI systems should integrate personal data protection into the design, establishment, operation and management of products and services using generative AI. The resolution then endorses for privacy protection, existing data protection principles and privacy principles as core elements for the development, operation and deployment of generative AI systems. These include the principle of purpose limitation and the principle of data minimisation.

Currently, AI and how AI should be regulated is receiving a lot of attention (at the European level). The coming months are also expected to bring more clarity on the AI Act and what the AI Act will finally contain.
